Failure to properly fill a prescription can have disastrous, life-altering consequences. Patients rely upon pharmacies to provide them their medication as prescribed by physicians. If pharmacies fail to use reasonable precautions, innocent patients may receive the incorrect dosage, or an entirely different drug than what was actually prescribed. A patient may unknowingly consume too much or too little of a given medication, resulting in injury. Alternatively, a patient may be injured when he or she ingests a drug that is contraindicated for his or her particular medical needs. A prescription medication may be mislabeled or provided to the wrong customer. We have successfully handled cases involving improper prescriptions resulting in brain damage and wrongful death. These types of injuries are avoidable. Pharmacies must be diligent to create procedures and systems that ensure prescriptions are filled precisely as prescribed. Pharmacies must also ensure that personnel hired are competent and reliable. All too often, after an injury, it has been discovered that pharmacy personnel that were involved in filling the prescription had backgrounds, criminal and otherwise, suggesting that they should never be involved in the process of filling prescriptions.
When a patient receives the wrong medication, they are at double risk of injury. First, they are taking the wrong medication. Second, they aren’t taking the medication that they need. Injuries and even death may follow. Common sense requires pharmacies to exercise great care to ensure that these avoidable events do not occur. Sadly, this doesn’t always happen.
